US Patent Office seeks public comments on AI inventorship for patents

As artificial intelligence (AI) continues to revolutionize the world of innovation, the US Patent and Trademark Office (USPTO) is grappling with a weighty question: Can an AI system be listed as an inventor on a patent?

In a Federal Register notice published on Tuesday, the USPTO announced that it is seeking public comments on the topic, as it attempts to incentivize and protect innovation, while also addressing the potential inventorship issues that may arise from the increasing use of AI in the innovation process.

This is not the first time that the USPTO has explored the complex issues surrounding AI and patent law. In 2019, the agency raised a series of questions on the topic, but the responses were mixed. Some believed that the law could handle AI-enabled inventions, while others argued that AI could invent something without human intervention.

In June 2022, the USPTO formed the Artificial Intelligence and Emerging Technologies Partnership to give stakeholders an opportunity to share their feedback and experiences. However, at a meeting of the partnership, participants presented conflicting views over whether AI is just another tool or if it can conceptualize patentable inventions or “contribute at the level of a joint inventor.”

The USPTO has also received patent applications that name an AI machine as the inventor, but under current law, “inventorship is limited to a natural person(s).” Although this decision was upheld in court, the question of whether human-made inventions with the assistance of AI were patentable remains unanswered.

To address this legal gap and the increasing role of AI in the innovation process, the USPTO is asking a series of questions, including how AI is being used in the invention process, what statutory changes should be considered, and what other steps the USPTO should take to incentivize AI-enabled innovation.

The USPTO is seeking public comments on the topic, and general comments and responses to the questions are due 90 days after the publication date via the Federal eRulemaking Portal. In the meantime, the USPTO is exploring ways to collaborate with academia to support increased academic engagement regarding inventorship and AI-enabled innovations.
